O-1 vs EB-1 vs EB-2 NIW

How three talent-based routes differ in evidence, timing and the rest of a person’s tax and family picture.

The key questions

  1. Begin with the intended outcome
  2. Evaluate evidence in context
  3. Include family, timing and tax questions
01

Begin with the intended outcome

Temporary work and permanent residence are different objectives. O-1 is a temporary work classification; EB-1 and EB-2 are immigrant preference categories, and a national interest waiver is a particular route within EB-2. Compare the intended activity and long-term plans before comparing evidence.

02

Evaluate evidence in context

Professional recognition, achievements, publications, leadership and the proposed work may matter in different ways under each route. A strong CV alone does not answer all eligibility questions. The evidence needs to address the relevant legal standard and the person’s actual field.

A better decision starts with the whole picture.

03

Include family, timing and tax questions

Consider dependants, travel, employment arrangements and the practical sequence of a move. Immigration status and tax residence are not interchangeable. Qualified immigration and tax professionals should assess those questions together where they overlap.

04

Use current official requirements

Eligibility, forms, fees and processing arrangements can change. Use current USCIS guidance and an individual assessment rather than treating a comparison chart as a conclusion about eligibility or timing.

General information for discussion with appropriately qualified professionals. The position depends on your circumstances, jurisdiction and current requirements.
